Terms & Conditions - Client & Talent

Section One - Talent


Booking Fee

Illume Casting Ltd ('Illumè') will take a percentage of total booking fee from the Talent for Stills, Commercials, Photographic, Editorial shoots, TV, Film, Musicals and Oversea Productions.

Power of Attorney

Illume Casting Ltd ('Illumè') will act as Power of Attorney for all bookings and payments made by the Clients and distribute the appropriate net amount to the Talent. Our Talents should inform the Clients to direct any monies directly to Illume Casting Ltd ('Illumè') who have the Power of Attorney to redistribute the net amount to the Talents.

Payment

Talents will usually be paid within 10 working days after Illume Casting Ltd ('Illumè') has receipt of the invoice from the Client and no more than 1 month after completion of booking/assignment; subject to the Client paying on time.

Initial Termination

Illume Casting Ltd ('Illumè') are contracted for 1 year from sign up. Either Talent or Illume Casting Ltd ('Illumè') may terminate by providing 7 days written notice of termination on the other Party; subject to the 30-day cooling off period. Termination notice must be provided in writing to Illume Casting Ltd ('Illumè') at the dedicated E-mail address provided at sign up.

General Termination

Illume Casting Ltd ('Illumè') contracts automatically renew on an annual basis. Renewal of contract will be processed automatically if no formal, written termination notice is provided by either party 7 days prior to contract renewal date.

Written notice of termination will be to the Talent's last known E-mail address and it is their responsibility to keep Illume Casting Ltd ('Illumè') fully informed and provided with up to date contact details.

Talents may terminate the contract by providing written notice of termination  to Illume Casting Ltd ('Illumè') at the dedicated E-mail address provided as per these terms dictate. 

Acting As Manager

Illume Casting Ltd ('Illumè') are acting only as a manager to the Talent by aiding them with getting assignments as and when possible.  

General Parent/Guardian/Talent Duties

It is the duty of the Parent/Guardian of the Talent to ensure the Talent's safety and provide full legal care during any assignments they are contracted to by Illume Casting Ltd ('Illumè'). 

Illume Casting Ltd ('Illumè') are in no way to be held responsible for the well-being, safety or legal care of any Talents whilst on assignment. Talents attend assignments at their own risk.

If at any time a Talent feels that their safety is being compromised, they must withdraw from the assignment and inform Illume Casting Ltd ('Illumè') immediately. 

It is the duty of the Parent/Guardian of the Talent, or the Talent themselves (if applicable), to ensure courteous, polite and professional behaviour when interacting/dealing/associating with Clients so as to not unduly hinder the name and/or reputation of Illume Casting Ltd ('Illumè') or any other Talents, employees, agents, consultants represented and/or associated by and/or with Illume Casting Ltd ('Illumè'). The same stipulation further applies to any social media sites, news or media outlets whether in person, digitally or online.

Client Rules/Regulations

It is the responsibility of the Parent/Guardian of the Talent, or the Talent themselves (if applicable), to fully comply with any rules, regulations or safety measures provided by the Client whilst on assignment, unless these are felt to be inappropriate, in which case Illume Casting Ltd ('Illumè') must be informed immediately. 

Breach

Any breach of these terms will result in immediate termination of the Talent's contract. 
 

Governing Body

These terms are governed by the Laws within England, Wales and shall be subject to the exclusive jurisdiction of the English Courts. 

Updates

We reserve the right to make changes to these Terms & Conditions at any time. 




Section Two - Client



Health and Safety

The Client is responsible for the Health and Safety of the Talent and Parent/Guardian (if applicable) during travel to/from bookings/assignments as well as whilst on booking/assignment locations. 

Services

The Client shall provide all services needed for the booking/assignment and the Talent as well as their Parent/Guardian (if applicable) - to some extent, will be viewed with the same due care as an employee of the Client during the booking/assignment.

Insurance

Appropriate Insurance Cover, where the Talent is concerned, must be attained by the Client.

Illume Casting Ltd ('Illumè') is not responsible for any losses that the Client may incur, for example, if the Talent fails to attend a booking/assignment due to unforeseen circumstances such as illness. 

Any losses must be wholly covered by the Client's Insurance Cover.

Breach

Any breach of these terms will result in immediate termination of the Talent's booking/assignment with the Client. 
 

Governing Body

These terms are governed by the Laws within England, Wales and shall be subject to the exclusive jurisdiction of the English Courts.

Section Three - UK Child Performance Licensing


General

Illume Casting Ltd ('Illumè') has the knowledge and experience to help Parents/Guardians with their complex child licensing requirements.

Illume Casting Ltd ('Illumè') work with all Local Authorities across the UK and can help to facilitate the process of the necessary license from start to finish. 

It is the Parent/Guardian's legal responsibility to ensure their child has appropriate licensing prior to any entertainment bookings/assignments. 

Licensing Queries

Parents/Guardians must contact Illume Casting Ltd ('Illumè') for any queries or concerns about timescales, fees or licensing requirements. 

Client Requirements

Clients are responsible by Law to apply for Child Performance Licenses for all jobs involving children of compulsory school age, or younger, according to the CHILDREN'S PERFORMANCE REGULATIONS 1968.

Notice

Under the current legislation, licence applications require 21 days notice. It is at the local Council's discretion to process a licence with less notice.

Fee

Illume Casting Ltd ('Illumè') can apply for licenses on the Client's behalf subject to a non-refundable fee of £45 GPB per Child/Talent. The fee is irrespective of whether the Child/Talent is confirmed for booking/assignment or not.

International Licences

International licensing is provided by the UK Magistrate's Court for a Child Performance Licence.
